Fiesta PZ Map is licensed to You (End-User) by Cato Technologies, LLC, organized in Wyoming, United States ("Licensor"), for use only under the terms of this License Agreement. This agreement applies only to Fiesta PZ Map. It does not cover any other app.
This is the end user license linked from Fiesta PZ Map on iOS, including the build in TestFlight, and on Google Play. The address in the app is https://catotechnologies.us/fiesta-pz-map/eula. The privacy notice in the app is https://catotechnologies.us/fiesta-pz-map/privacy-policy.
By downloading the Licensed Application from an app store, and any update to it, You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement.
The parties of this License Agreement acknowledge that the app store is not a Party to this License Agreement and is not bound by any provisions or obligations with regard to the Licensed Application, such as warranty, liability, maintenance and support thereof. Cato Technologies, LLC, not the app store, is solely responsible for the Licensed Application and the content thereof.
If You downloaded the Licensed Application from Apple's App Store, this License Agreement is not meant to conflict with the Usage Rules in the Apple Media Services Terms and Conditions. If You downloaded it from Google Play, Google Play's terms apply to that download.
The Licensed Application, when downloaded through an app store, is licensed to You for use only under the terms of this License Agreement. The Licensor reserves all rights not expressly granted to You.
The Licensed Application is Fiesta PZ Map, software from Cato Technologies, LLC. It shows the prohibited-zone map for the Albuquerque International Balloon Fiesta and the pilot's position on that map. It is an aid for the pilot.
2.1 You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on devices that You own or control, for Your own use. If You downloaded it from Apple's App Store, You may use it on Apple-branded products You own or control, as permitted by the Usage Rules, and other accounts associated with You may access it through Family Sharing or volume purchasing where those rules allow. If You downloaded it from Google Play, You may use it on Android devices You own or control, as Google Play's terms allow.
2.2 This license will also govern any updates of the Licensed Application provided by Licensor that replace, repair, and/or supplement the first Licensed Application, unless a separate license is provided for such update, in which case the terms of that new license will govern.
2.3 You may not share or make the Licensed Application available to third parties, sell, rent, lend, lease, or otherwise redistribute the Licensed Application, except to the degree an app store's own rules allow a family or volume install.
2.4 You may not reverse engineer, translate, disassemble, decompile, modify, or attempt to derive the source code of the Licensed Application, or any part thereof, except where applicable law does not allow this limit, or with the Licensor's prior written consent.
2.5 You may not copy the Licensed Application except for a backup on a device You own or control, and except where this license or the app store expressly allows it. You may not remove any intellectual property notices. If You sell Your device to a third party, You must remove the Licensed Application from the device before doing so.
2.6 Violations of the obligations mentioned above, as well as the attempt of such infringement, may be subject to prosecution and damages.
2.7 Licensor reserves the right to modify the terms and conditions of licensing. The updated version will show a new date at the top of this page.
2.8 Nothing in this license should be interpreted to restrict third-party terms. When using the Licensed Application, You must comply with applicable third-party terms, including the terms of an official chart publisher and of a form the app opens.
3.1 You are responsible for confirming that the device on which You install the Licensed Application can run it.
3.2 Licensor attempts to keep the Licensed Application updated so that it continues to run on current devices. You are not granted a right to claim a particular update.
3.3 Licensor reserves the right to modify the technical requirements as it sees appropriate at any time.
4.1 The Licensor is solely responsible for providing any maintenance and support services for this Licensed Application. You can reach the Licensor at [email protected].
4.2 The Licensor and the End-User acknowledge that the app store has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
The Licensor's use of information is subject to the privacy notice at https://catotechnologies.us/fiesta-pz-map/privacy-policy. A position drawn on the map for the blue dot and the 10-minute line stays on the device, as that notice describes.
The pilot in command is responsible for the flight. Fiesta PZ Map is a tool. It does not replace official charts, weather, or air traffic control. Official charts govern, and the Fiesta file governs the prohibited zones Fiesta PZ Map draws. That file is the one on the pilots page: https://www.balloonfiesta.com/pilots-and-crews/pz-maps/.
The 10-minute line is an aid. It is not a clearance.
A landing form opened in the browser goes to the owner of that form. For Fiesta PZ Map, Landing opens the City of Albuquerque Survey123 form at https://survey123.arcgis.com/share/9bdd5cae977d48f3ad7b938c5f28ecaa. Cato Technologies does not receive that submission.
To the fullest extent the law allows, Cato Technologies, LLC is not liable for a flight decision, a missed zone, a position that is wrong, a line that is wrong, a download that fails, or a form that does not go through. The Licensor is not liable for lost profits or other indirect or consequential damages.
The Licensor takes no responsibility for damages caused by a breach of the restrictions in Section 2. If You alter the Licensed Application, You may lose the use of it.
This limitation does not apply where the law does not allow it, including injury to life, limb, or health, and harm caused by intent or gross negligence.
The Licensed Application is provided as-is and as available. The Licensor does not warrant that a map, a position, a 10-minute line, or a download is complete, current, accurate, or fit for a particular flight.
No warranty is provided for a Licensed Application that has been modified without authorization, or that cannot run because of the device, the network, or other causes outside the Licensor's control.
If You downloaded the Licensed Application from Apple's App Store and it fails to conform to an applicable warranty, You may notify Apple, and Apple will refund the purchase price of the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the Licensed Application. Any other claim arising from a failure to conform to a warranty is the responsibility of Cato Technologies, LLC, not Apple.
If You downloaded the Licensed Application from Google Play, any refund of a purchase price follows Google Play's rules. Google is not responsible for the Licensed Application.
Cato Technologies, LLC and the End-User acknowledge that Cato Technologies, LLC, and not the app store, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User's possession and use of that Licensed Application, including:
You represent and warrant that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and that You are not listed on any U.S. Government list of prohibited or restricted parties.

The license is valid until terminated by Cato Technologies, LLC or by You. Your rights under this license will terminate automatically and without notice from the Licensor if You fail to adhere to any term of this license. Upon termination, You shall stop all use of the Licensed Application and delete all copies, full or partial, of the Licensed Application.
Cato Technologies, LLC will comply with applicable third-party terms when offering the Licensed Application.
If You downloaded the Licensed Application from Apple's App Store, Apple and Apple's subsidiaries are third-party beneficiaries of this End User License Agreement and, upon Your acceptance of it, Apple will have the right to enforce this agreement against You as a third-party beneficiary.
If You downloaded the Licensed Application from Google Play, Google's store terms apply to that download. The published map and any form opened in the browser have their own terms. Those sites are not parties to this license.
Cato Technologies, LLC and the End-User acknowledge that, in the event of any third-party claim that the Licensed Application or the End-User's possession and use of that Licensed Application infringes a third party's intellectual property rights, Cato Technologies, LLC, and not the app store, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
This License Agreement is governed by the laws of the State of Wyoming, excluding its conflicts of law rules.
16.1 If any of the terms of this agreement should be or become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated in a way that will achieve the primary purpose.
16.2 Changes to this agreement are posted on this page, which remains https://catotechnologies.us/fiesta-pz-map/eula.
